General Terms and Conditions for Hotel Contracts with Hotel Neue Post Erwerbs und BetriebsgmbH

Preamble

All contracts and agreements relating to these terms and conditions must be made in writing. Individual agreements (framework agreements, etc.) may regulate individual points in more detail and also deviate. In all other respects, the following shall apply, in order: these Terms and Conditions, separate detailed contracts, the HNP House Rules, the terms of the Cooperation Agreement on the Provision of Accommodation and Catering of the Association of Hotel and Lodging Companies with the Association of Travel Agencies.

Conclusion of contract

  • Contracts are concluded on the basis of these terms and conditions as soon as the room(s), rooms, areas, other deliveries and services are ordered and confirmed. As far as possible, HNP shall confirm reservations in writing. If advance payments requested by the hotel are not made on the date requested, the agreement made shall become invalid.
  • If the content of the reservation confirmation deviates from the content of an offer or registration, the deviating content of the confirmation shall become binding for the Contractual Partner and HNP if the Guest does not expressly object immediately after receipt of the reservation confirmation.
  • If the Contractual Partner is a registered trader, it shall be liable for all contractual obligations in addition to the guests it has arranged.

Reservation

Each reservation order shall only become valid upon written confirmation (fax, e-mail) from HNP. The confirmation shall contain a unique reservation number (ResID), the scope of the service (category, number of persons, duration), the prices and the conditions for the booking. If there is no framework agreement, the reservation shall only be deemed confirmed and booked once the obligatory deposit has been paid into HNP's account. (Generally 33% of the booking amount.) In the event of cancelations, the deposit will be charged and retained as a cancellation fee. Unless otherwise agreed, a reservation shall be deemed to have lapsed if the deposit amount has not been received in HNP's account no later than 14 days after the date of the reservation confirmation. HNP reserves the right to charge a cancellation fee in this case as well.

Hotel voucher (voucher)

A voucher must contain the reservation number (ResID) and the service details, in particular the arrival and departure dates. This data must match the reservation confirmation. Any additional services will either not be provided by HNP or will be charged directly to the guest at HNP's conditions. A voucher as a method of payment will only be accepted by separate agreement. Otherwise, the booking amount must be transferred in full before arrival or secured by a credit card or similar. Bookings will be charged on the day of arrival. In the event that payment is to be made by the guest, this must be agreed separately and clearly indicated on the voucher.

Arrival and departure

Reception is normally open from 7 am to 10 pm.

  • The rooms are available from 3 p.m. on the day of arrival and are available until 6 p.m. at the latest without special agreement; if a deposit has been paid, until 12 p.m. at the latest on the day following the day of arrival. After this time, HNP is entitled to reallocate the rooms unless otherwise expressly agreed in writing. A credit card authorization or a cash amount (€200) must be deposited as security on arrival. On departure, the amount will be offset or refunded as necessary
  • On the day of departure, the room must be vacated by 12 noon at the latest. If the room is vacated late, HNP is entitled to charge 50% of the daily rate. In the event of a planned departure after 10 a.m., the guest must inform reception of this, provided the hotel agrees to this, half the room price must be paid for departures up to 6 p.m. and the full room price after 6 p.m.

Cancellations or early departures

  • must be made in writing and must refer to a clear reservation. Cancellations only become valid upon written confirmation from HNP. A processing fee of € 25,- per reservation will be charged for all cancelations. Cancellations are generally possible up to 28 days before the agreed arrival date without any other cancellation fees Deposits made will either be credited 100% to an upcoming booking or refunded minus the processing fee.
  • The following conditions apply to cancellations made within 28 days of the agreed arrival date:
    - up to 14 days: 33% of the booking amount
    - up to 7 days: 75% of the booking amount
    - until the day of arrival, in the event of no-show or early departure the total amount will be charged, any replacement bookings can be offset.

Cancellations

HNP has the right to dispose of non-guaranteed room capacity 60 days before the agreed arrival date; 21 days before the agreed arrival date up to a maximum of 50% of the agreed, non-guaranteed capacity; 14 days before the agreed arrival date up to a maximum of 25% of the agreed, non-guaranteed capacity. HNP will inform the travel agency of this by fax or email.

Terms of payment

  • Unless advance payments are to be made anyway, all claims of the hotel are due at the latest on the guest's arrival and must either be settled at the hotel or secured by a bank guarantee.
  • For stays of more than 3 days, HNP reserves the right to issue an interim invoice.
  • Invoices billed to the guest must be paid directly at the hotel, either in cash or by accepted credit card.
  • Invoices with payment terms are due 14 days after the date of issue, net to HNP's bank account. All charges resulting from the payment transaction shall be borne by the invoice recipient. If the payment term is exceeded, the invoice recipient undertakes to pay the costs of a debt collection agency in addition to bank default interest of at least 1% p.m. and agrees that in the event of late payment, interest will be capitalized up to the day of the claim and collection charges will be added to the capital.
  • Default in payment shall entitle HNP to refuse to provide any further services under any current contract and to withdraw from contracts for future services; in addition, HNP shall be entitled to charge the loss incurred as a result in the same way as if this withdrawal had been declared by the guest.

Liability

  • The contractual partners of HNP or the guest as such or as host shall be fully liable to HNP for any damage caused by themselves or their guests and for which they are responsible.
  • Any use of the rooms provided by the guest that deviates from the agreement shall entitle the hotel to terminate the contractual relationship without notice, without this reducing the entitlement to the agreed remuneration.
  • If HNP is hindered in the performance of its services due to force majeure, technical faults, strikes or similar, no liability for damages can be derived from this. However, HNP shall be obliged to the customer to endeavor to procure equivalent services elsewhere.
  • HNP shall be liable to the guest in accordance with the provisions of the Austrian Civil Code (ABGB). The hotel shall not be liable if the room or the containers in which the guest leaves items are left unlocked. HNP accepts no liability for valuables in the rooms, including those locked in the room safes.
  • HNP shall be liable for the accuracy of the service description and the proper provision of the contractually agreed services.
  • HNP shall not be liable for the services of cooperation partners and events arranged by HNP.
  • In the event of any service disruptions, the guest/organizer is obliged to do everything reasonable to help remedy the disruption and minimize any damage. The guest/organizer is obliged to inform the hotel management immediately of any complaints. If the guest does not fulfill this obligation, he/she shall not be entitled to any claims.
  • Participation in sports and other vacation activities is the responsibility of the guest. The guest is required to always check sports facilities, equipment and vehicles before using them. HNP shall only be liable for accidents that occur during sports events and other vacation activities if it is at fault. It is recommended that guests take out sports accident insurance.

General information

  • The hotel will carry out wake-up calls with the greatest possible care. However, claims for damages due to non-fulfillment are excluded.
  • Information of any kind will be provided to the best of our knowledge, but without guarantee.
  • Lost property (items left behind) will only be forwarded on request against reimbursement of costs. The hotel undertakes to store these items for up to 6 months, after which time they will be disposed of.
  • Messages, post and consignments of goods will be handled with care for the guests. The hotel will store, deliver and, if requested, forward them. However, liability for loss, delay or damage is excluded.
  • In the case of free transportation of persons and luggage, HNP's liability for personal injury and damage to property is limited to the statutory motor vehicle insurance. Liability for losses and delays is completely excluded.
  • The customary local taxes are not included in the arrangement and apartment prices, in particular also in TimeShare and in HNP Club arrangements  and must be paid separately

Additional, special information for TimeShare

  • Utilities such as electricity, gas, water, heating, bed linen and towels are included. The local tax and final cleaning are charged separately depending on the stay, number of persons aged 15 and over and apartment.
  • The apartment may only be occupied by the number of adults and children specified in the reservation confirmation.
  • The arrival and departure dates are binding.
  • Each guest undertakes to treat the accommodation unit together with the inventory and any communal facilities with care. They are also obliged to compensate for any damage caused during their stay through their own fault or the fault of their companions and guests.
  • When the keys are handed over, a reasonable amount (at least € 500) may be demanded as security for any damage. Repayment or settlement shall be made if the accommodation unit or the inventory has been returned in a properly cleaned condition at the end of the stay.
  • On departure, vacation apartments must be left in a swept clean condition. If used dishes are left behind, a surcharge of € 50 will be levied.

Final provisions

  • We reserve the right to correct errors as well as printing and calculation errors.
  • Verbal agreements shall only become effective once they have been confirmed in writing by HNP.
  • The place of jurisdiction for any disputes arising from this contract and its fulfillment is, as far as legally permissible, the jurisdiction of the court of Zell am See.
  • Should one of the above provisions be invalid, this shall not affect the validity of the other provisions. The invalid provision shall be replaced by a valid provision that comes as close as possible to it.

Additional conditions for travel groups 

Travel groups  are bookings of 10 rooms or more per booking 
The following conditions apply to travel groups.

Price basis
Double room with breakfast or with half board

Deposit
At least 30% of the total booking amount
The reservation will only be confirmed upon receipt of the deposit

Payment
The total booking amount must be paid in full no later than one week before arrival.

Group cancellation and reduction conditions

As a general rule, it should be noted that the term "cancellation" refers to a total cancellation of the entire contingent at the hotel.

The term "reduction" refers to a reduction of an existing company block booking and/or a reduction of individual group bookings/= individual bookings.

Total cancellation

In principle, a free cancellation is only possible by special arrangement, within 90 days before the day of arrival a free cancellation is no longer possible at all.

The following conditions apply to reductions of the group contingent

Conditions for reductions of group bookings

  • Within the period of up to 60 days before arrival, a free reduction of 30% of the booked rooms is possible.
    For each room reduced beyond the 30%, a reduction cancellation fee of 20% of the booked room revenue for the booked stay is due.
  • Within the period from 59 to 14 days before arrival, a further reduction of 20% of the booked rooms is possible free of charge.
    For each room reduced beyond the 20%, a reduction cancellation fee of 50% of the booked room revenue for the booked stay is due.
  • Within the period from 13 days to 24 hours before arrival, a reduction of 10% of the booked rooms is possible free of charge. For each additional room reduced by more than 10%, a reduction cancellation fee of 80% of the booked room revenue for the booked stay is due.
  • No free reduction is possible from 24 hours before arrival. For each room reduced thereafter, a reduction cancellation fee of 85% of the room revenue for the booked stay will be charged.
  • No-shows
    No-show rooms on the day of arrival will be charged at 100% of the agreed room rate for the entire stay. The hotel will therefore keep the no-show rooms as originally booked. Name changes are not affected by this.
